Am I the jerk?

A buddy and I were hunting a public piece 25 years ago on a morning sit. We are 100 yards apart and right at pink light he sees a guy walking his way and watches the guy climb a tree about 35 yards away. My buddy doesn't say anything as this guys stand is facing away from him and he didn't want to mess up the morning hunt so he just sits there stewing. Half hour later a nice 6 point is headed down the run at 25 which goes between their stands. My buddy comes to full draw, bleats and drills this buck. My buddy said the other guy had seen it, turned to shoot it on his left side, but he shot it about 10 yards before it made it to where the guy was going to shoot! The guy had no clue my buddy was there, and the shot scared the *&%^&* out of him! He was decent dude, but took his stand down and bailed shortly after we talked with him.
 
There is a lot here, but I would have moved. If he was in the wrong by going in before the local regs allow, that is baloney, but I still wouldn't mess his hunt up.

Let me put it this way, if you rolled in on me and setup at that proximity, I would be upset - and we would have a conversation. Here in my area, we don't have regs that restrict you from being the early bird.

I went to a new spot on public that i had never been to before for an evening hunt. Walked a pretty good ways and then decided to come back to spot i had already passed. So i get half way up the tree and a lady walks buy squirrel hunting so we make small talk she asked if that was me that was over at the other spot( i didnt see anyone) and i said yes. She left and about 20 minutes until hunting was over she walks back by me knowing i was there. Wish people would have more respect for other hunters. For someone to walk right under your stand at prime time when they know you are there is wrong.
 
A few years ago I scouted my way into a spot for the evening hunt on opening day of archery. Halfway through my sit I hear a sound and turn around to see a guy going up a tree 40yds away. I whistle and he doesn't look. I am tempted to get down but decide to stick it out, its almost prime time, no sense ruining both of our hunts and he doesn't know im there. A stick pops a little later and a group of does comes out, I shoot the largest. I text my buddy to come help me drag after dark and am sitting there in my tree and 20 minutes later another group of does comes out. I shoot the biggest one. I start climbing down.. This guy gets down and walks over to the base of my tree, says he knew he heard a bow go off but didn't see anyone around. I tell him, yeah, I shot two deer. He sticks around to help me track and turns out to be a good dude. He was up from Indiana with some friends for a deer camp, wasn't sure how he was gonna tell his camp that he didn't see anything but the guy in a tree 40yds away got two

this is my story. I cleared a tree 3 weeks before season on private land to sit in my saddle. I go in in the dark 3 weeks into season and find a set of climbing sticks and a treestand in the same tree. what would you do? continue sitting in it or move to a different area. its just a small 5 acre woodlot.

Wow. That's rough. I guess you have to move since his placeholder was there first. I leave a mason's line loop in a tree I want to hunt. If someone was hunting my tree anyway on public land, I would just move to a different tree. I don't have private land to hunt.
 
I say walking in to someone hunting you move in but if I’ve shot a deer and tracking it it’s different. BUT
I would wait until close to 11am or dark to track and all bets are off. I’m following the blood trail right by another hunter. Most times they offer to help. If you wait to long in the mornings you can bet you will have other hunters coming in for an afternoon hunt between 1-2 pm.

How did you prep the tree? It sounds like you made it the perfect tree and someone noticed your work. 5 acres? How many people are hunting there?

I have literally had guys walk up to me while I’m in a tree and mark the tree I’m in on public land.
Biggest buck I ever shot at (missed, bow) was killed the next day with a Rifle out of my buddy stand on public land by a hunter I didn’t even know. 184” huge main frame 10 with mass after mass. He was wide enough you could see one side of his rack above the bed rails of a full size Chevy. My friend was talking to the lucky hunter at the gas station and the guy told him where he killed it, even said he shot it from a buddy stand he found out there on public that hadn’t been hunted since juvenile weekend.

Around here a lot of guys put stands out and others hunt them. Myself and two other guys used to put out closed to 40 stands on our local 11,000 acre public land. We have always treated it like our lease. We knew where dozens more were hung. (Not ours)
They changed the law and now they have to be hunted every 24 hrs or they are considered abandoned. The game warden got tired of carrying them out where people would just leave them.
