Hunter/Homeowner Confrontation

Kudos to you for a couple things. First and foremost keeping a calm head. It’s your land and you know you’re in the right, easy to fly off the handle. I’m in favor of carrying to protect myself, and my family, from all manner of threat. That said I personally believe there is a great responsibility in doing so, pretty clear you understand that if it stayed on your hip, forgot it was there or not.
Actually its pretty easy to maintain your cool when you know you're gonna be gone heading towards home sometime that day and they are still gonna be around to do whatever they want with your land. I'm in a position where its definitely counter productive to aggravate your neighbors. Once I'm headed toward home they're going to be free to do whatever they want for retribution. In my case its better to try to keep them thinking I'm a decent guy and hopefully they'll treat the land with some respect. If I lived on the property things may have transpired a bit differently . . . its hard to say.
 
Well let see…..you’re an absentee landowner. Multiple neighbors are hunting the hell outta your property. You don’t seem to like it, but you’ve resigned yourself to accept it. Might I offer an alternative?

How about giving permission to hunt your property to an LEO?

P.S. don’t pick a GW, they’ll be out working. You need a veteran LEO as they will have the most amount of useable leave. Picking one that works second shift is good as they will most likely hunt mornings, especially if they don’t have young children. A first shift officer whose patrol area includes your land is another good choice.
 
I hate rednecks with the burning passion of 1,000 Suns. I have no issues with poor people or country people. But I've been dealing with low IQ rednecks (aggressive and ignorant types) that think they are smart for over 40 years, and it's getting old.
Took the words out of my mouth. It seems like in the last few years they've gotten louder and dumber. I used to joke about being a redneck myself. I don't anymore. The line between redneck and plain white trash has grown too thin.

Honestly I don't mind if people (neighbors or otherwise) use the property if they treat it with some respect. It's not posted, and in fact I made the one neighbor who I caught in the act of posting it one day many years ago go back and pull the signs he had already put up.

I can say that I don't much like being told to get off of my own property though by people who have no right to do so. If they're trying to boot me off they're likely booting others off as well.

I have given permission to hunt there to several friends, family and even a member of this forum but even though they're closer, they're still far enough away to not be there often. As far as LEOs, I'd be happy to offer permission but it's a small town (no local police, only county sheriff/deputies or State Police) and I wouldn't have the first clue who to discuss it with. The only reason I'd have contact would be if I had a serious issue that I couldn't work out myself and needed to call 911. Thankfully that line hasn't been crossed yet.

You know....if I ever had a large, out of state lease....it would probably make a lot of sense to find a DNR officer nearby to that property and give him or her hunting permission. And get him or her excited about managing the property for nice bucks. Once that was known, poaching and trespassing would probably shrink towards zero.

Yeah, I probably should use a different word because a lot of folks that are just proudly countrified use it to thumb their nose at city slickers.

I’m not talking about them at all. Just dudes you wouldn’t let watch your goldfish.
 
Trespassing is a misdemeanor. Even in Castle Doctrine States like GA you do t have the right to brandish a weapon to a trespasser. I have read so many threads that have keyboard badasses stating they would shoot the trespasser, string the trespasser up, etc. In my home state of GA, even if you have posted signs, unless you as the land owner have signed an affidavit with names listed of who is allowed on the property a trespass case will not hold up in court. The only thing law enforcement can do is issue a warning.

Two yrs ago my wife who is an RN, and worked 3rd shift at the time, would come home from work, sit on the back porch, and wind down by drinking a couple of beers. One night she had an older man walk within 10’ of our back porch, stare at her for a few minutes, and walk off. The next morning she told me about it, and I 1/2 way believed her. We live dead center of about a 49 acre block of woods, and have a 2000’ driveway. No one comes to our house, without notice so why would an old man be walking up to our porch at 1am. So, being the living husband I am, I put up several trail cams around the house , and sure nuff our weird ass neighbor for about 1/4 mile away was roaming our property at night. I called the cops 7 different times on him within 3 months. I even filled out the affidavit, had him on camera, and they still couldn’t prosecute. He would always disappear before the cops got there. I actually saw him walk behind a tree and hide one night when the cops were there. I recorded him crossing onto my property using a thermal. I took the evidence to the Sheriff, and was told “he’s trespassing, your life is not in danger from that. Any use of deadly force will land you in jail.” I was also told holding him at gun point until the law could get there would be a felony charge, and I would have to leave it for a jury to decide. I cured the problem, but it took a lot of creativity, and was very expensive.

Dead men can’t stand trial, I’d get the wife to shoot him while I’m not home and that’ll hold up any day of the week. A wife alone at home with kids is a far better sell for self defense then a military trained operator such as myself. I live in dang near same sort of situation here in N. LA and our own sheriff told us “you know our response time so act accordingly”. And the sheriff can’t say you aren’t in danger, that’s the thing you don’t know you’re in danger until you’re in danger, best to not wait around for the purp to decide. What I’m saying ultimately is if someone comes to my place they would have to dang near brandish a weapon themselves before I pull a trigger bc I know what a trial would look like, but if the wife is home along with the kids a man with no weapon can be considered significant force multiplier. Ultimately if you or anyone ever pulls a trigger there will be a trial and there’s no such thing as a 0% conviction, have your ducks in a row and again, dead men can’t stand trial. I’ve stood trial before for putting someone down, I was 15 and home alone with my then 10 yr old sister it was a clean case, if me today would be in same situation I’d probably be in jail. It’s all about if the force used can be seen as logical by the jury. And it’s not fun even when you’re in the right so best not to. What I teach/taught is before you pull the trigger just think to yourself, can this stand up in court bc it will go to court.

I heard some crazy woman knocked on his door, and told his wife she was pregnant. His wife then kicked him out. But, I spent all of the money beefing up security. You know alarm systems really do a good job of keeping folks off your land.
