Trespassing

Jesus. Several pot grows? Thats pretty scary. I know the Leo that works at my office would be decked out in multi cam from head to toe with face paint on rearin to shut that down. Heck, his K9 would be in camo and goggles. Wouldnt have to ask twice.

West Virginia has such a large opioid and heroine problem that law enforcement doesn't have the time to spend running down small scale pot growers. I've talked with state and DEA agents in my area and right now their only investigating the big fish. We have a lot of dealers that come down from Detroit and Chicago area.
 
I feel your pain. Within the first 5 seconds of conversation with our local sheriffs department the detective on the line felt the need to explain how hard it is to prosecute trespassing. Not a huge priority for them. I don’t think they would ignore a pot growing operation but I don’t for sure. Local game warden has been more helpful.

Today I spoke with the local game warden again, told him what I was doing with the cameras I put out on all my entrance and along were the county rd runs through my property. Evidence that I gather from them he wants copies. Guess calling everyday and being a thorn in his side works.

The landowner actually was charged and found guilty of a crime in this case... setting any kind of trap is usually illegal, especially when the trap involves explosives (which firecrackers technically are)

Dude, they care more than people think or want to act like. Especially pot grows. No question. If people are growing pot illegally, the law will pursue. This makes individual LEO/local LE Unit look awesome to superiors. (Not to take away from seriousness of crime) They will jump on this. Here in AR, when I am out marking timber, our GW wants to know about stands left up after the 2 week after season grace period (March). I GPS every stand and send to him. He monitors for baiting and resource damage. Most people that put up ladder stands and blinds on public land cause resource damage... intentional or not they get a hammer f7,@8!(. He hammers them deep like. Maybe its wildly different in your area but I live in a notorious “outlaw” wanna be place in the Ozarks and we still have great LE activity. God bless you and your service. I just cant believe that no LE will help you and the constant issue of tress passing/federally illegal crime of cultivating narcotics on your property.

your local police could be involved with the pot growers is why they are not acting
I saw some place on youtube where someone like you had similar problems
so he would setup his truck near the poachers and play his electric guitar loud as possible during hunting season

found the video seems like he posts a new video each year about this

Remember that movie Men At Work from 1990 with Charlie Sheen and Emilio Estevez? They used to prank their coworkers with exploding s#!t air bags. Maybe set one of them up next to the cheap trail camera. Then you'll get that on camera too.

I wonder what his fine/sentence was. It might would be worth it. Maybe without the paint though. Just a sound deterrent to prevent “bears” from tampering with trail cameras.

They sell booby traps on Amazon. Just use a 22 blank to make noise. They won't hurt anybody but it may scare people a little bit in the dark. It's a damn shame somebody who is trespassing on your land should be able to sue you for anything. If they fall out of a deer stand and get hurt the landowner is liable. Seems bass-ackwards to me. And people wonder why folks don't like them trespassing on their land.

I agree it’s crazy to think while trying to keep people off your land your rights as a landowner don’t seem as good as their right to sue you.

This is one thing MD got right.

"Under current Maryland law, a hunter may not go onto another person’s land to hunt without written permission (Maryland Code, Natural Resources Article, Section 10-411(a)). Further, any hunter on private property is liable for any damage caused to the property, and the landowner is not liable for accidental injury or damage to the hunter (Section 10-411(b-c)). "

I may be wrong, but i don't think you need a cop to file a complaint with the courts. Just make sure you have a case ,and the evidence to back it up. It may cost you a small filing fee.
